AAB Wins Major Victory in New York 

The New York Court of Appeals, the highest court in the state of New York, today denied the New York State Department of Health’s (NYSDH’s) request to appeal to that court regarding AAB’s lawsuit alleging that the NYSDH’s Clinical Laboratory Evaluation Program (CLEP) was intentionally overcharging clinical laboratories to subsidize other activities that had no relation to regulating clinical laboratories. 

This exhausts the NYSDH’s appeals and ends, in AAB’s favor, 12 years of litigation. The NYSDH must now provide refunds to the laboratories that were plaintiffs in AAB’s lawsuit.
